Welcome to BALLOONS AND JOY!

In the following document we describe in detail the current rules and regulations for the use of the BALLOONS AND JOY website, located at balloonsandjoy.com. Throughout the site, the terms “we”, “us” and “our” refer to BALLOONS AND JOY as a company.

By accessing this website, we assume that you accept these terms and conditions, otherwise please do not use any of our items and/or services. We recommend that you read these terms and conditions carefully before continuing your regular browsing.

Do not continue to use BALLOONS AND JOY if you do not agree to all of the terms and conditions set forth on this page.

This website is constantly updated, it is your responsibility to keep up of the regulations established during updates, all of them will be added to this website.

Services:

 We provide balloon decoration services for various events and occasions.

Refund Policy:

We do not offer refunds for installs or deliveries. There is a 50% non-refundable deposit for all installs to secure the date. If you need to change the date of your event you may do so, but please know that dates are first come first serve. If you no longer need balloons for an install we can do a balloon creation for the amount of your deposit or can be used for future event.

Rescheduling:

The Client has the freedom to reschedule the installation with a written 7 (seven) day notice. The Client may reschedule for any date within the next 365 calendar days, at the convenience of Balloons and Joy, without being charged a cancellation fee. The reschedule date is subject to availability. We suggest that if the Client needs to reschedule, they include the preferred date to reschedule as well as a second choice, in the event that the first choice is unavailable.

 Liability:

We are not responsible for any injuries, damages, or accidents that may occur during the event related to our balloon decorations.

DELIVERY POLICIES AND PROCEDURES

We deliver orders personally, if we can’t make a delivery due to changing laws or facility restrictions, we will let you know and give you the option to reschedule, change delivery address, or cancel.



OUR DELIVERY WINDOWS:

1) 10:00am to 12:00m.         

2) 12:00 M - 3:00 pm     

3) 3:00 pm to 5:00 pm.    

Please send us an email info@balloonsandjoy.com to inquire about our availability if you would like a delivery before 10 am or after 5 pm.

NON-CONTACT DELIVERIES

We will be scheduling non-contact deliveries whenever possible. For all deliveries, we will contact you to confirm the delivery details before preparing the order. 

We will notify you in the event that we are unable to make contact with someone at the delivery destination or if the receiving facility is unable to accept balloons.

Someone must be available at the delivery location to receive the balloons at the time we deliver. If the balloons need to be delivered outside, we will confirm that someone will be available to bring the balloons indoors. 

PRODUCT AND SERVICE COMPLAINTS

We will take prompt action to address service issues that are reported no later than 2 days after delivery. After this deadline no replacements, refunds, or credits will be issued. In order for us to provide a replacement or refund, we require that a photograph of the balloons be emailed to info@balloonsandjoy.com with a note providing the order number.

ANONYMOUS DELIVERIES

We are unable to provide anonymous delivery service. In cases where a signature is not provided on the greeting card which accompanies an order, we will reveal the name of the sender to the recipient if requested.

BALLOON DELIVERIES TO A BUSINESS

If the recipient is unavailable when we arrive, the balloons will be left at the business location.

BALLOON DELIVERIES TO A RESIDENCE

Balloons must be accepted in person and will not be left at the entrance unattended. 

BALLOON DELIVERIES TO A HOSPITAL

We will contact the hospital prior to delivery to ensure that balloons are permitted for the patient and to ensure that the patient is still a hospital guest. Only mylar balloons are permitted for hospital orders.

Hospital policies vary and it may not be possible for our staff to make a delivery directly to the room of the patient. Many hospitals require that the balloons be dropped off at a security station, from which the balloons are delivered to the patient by the hospital staff. The staff may need to delay the delivery to the patient for any number of reasons. Please feel free to contact our main dispatch center if you have a concern about the status of your order.

If we are cleared by the hospital to proceed with the delivery, but the hospital refuses the delivery when we arrive, the order will be considered delivered and no refund will be issued. If the delivery can be made to an alternate address which is within our service area, an additional delivery charge may apply.

If we are cleared by the hospital to proceed with the delivery, but the patient is subsequently discharged prior to our arrival, two options become available — 1) The order can be delivered to another local address for an additional delivery charge, or 2) The order cannot be delivered and must be canceled. In this case, no refund will be issued.

BALLOON DELIVERIES TO A HOTEL

Deliveries to hotel guests are made in care of the front desk, bell desk, or concierge. The customer is responsible for ensuring that the hotel completes the delivery.

BALLOON DELIVERIES TO A SCHOOL

Not all schools permit balloon deliveries to students. Those that do require that the delivery be made to the main office. The customer is responsible for ensuring that the school office contacts the student to pick up the balloons.

SEVERE WEATHER POLICY

In the event of forecasted severe weather, Balloons and Joy will contact the customer at least one day prior to delivery to reconfirm or postpone the order.

Balloons and Joy is not able to change or cancel an order if the request is made on the delivery date.

HOW TO CANCEL AND CHANGE ORDERS

Please send your request by email to info@balloonsandjoy.com within 24 ours of placing an order. Please consider your order canceled or changed 

Installation: 

1. Balloons and Joy begins on site installation /delivery of décor if permitted approved by the Venue same day of the event. 

2. It is the Client’s sole responsibility to confirm if the venue allows; helium tanks, helium balloons, tall structures, wall hangings, tall ladders, etc. prior to any payment made to Balloons and Joy. If the Client fails to confirm the venue’s rules for balloons, helium tanks/balloons, wall hangings, tall ladders, etc. prior to making any payment(s), said payment(s) will be forfeited and considered non-refundable. It is your responsibility to make arrangements for Balloons and Joy to gain/maintain access of the venue. The Client is also responsible for obtaining any permits, access passes, gate/room access cards, wristbands for entire staff, as well as notify Balloons and Joy of any room changes within the venue, if applicable, with at least 24 hours notice. Access arrangements apply to access prior to the event for installation, as well as access to strike, if applicable, or breakdown any props, designs, equipment, etc. If props/designs/equipment are transported by the Client, the Client may return said items to Balloons and Joy the following day. . Balloons and Joy request client to inform venue staff or management that Set up time of at least 2 hrs is needed.


 3. All equipment, materials, and props used for the installation, are the sole property of Balloons and Joy and are used on a rental basis only.

• The Client is responsible for access to retrieve said equipment, materials, and props after the event.

• Signing the Terms & Conditions makes the Client solely responsible for the equipment, during and after the event, until surrendered back to Balloons and Joy.

• Failure to do so, will result in the Client accepting sole responsibility for the property of Balloons and Joy and agrees to have the card on file charged or be sent an invoice and agrees to pay it.

• Any damage or vandalism that occurs to any of the property during the event, including any damage or vandalism that occurs due to the Client’s guests, will result in the Client accepting sole responsibility for the property of Balloons and Joy and agrees to have the card on file charged or be sent an invoice and agrees to pay it. This includes but is not limited to misuse, theft or disasters (fire, flood, earthquake).

. All props and equipment are the property of Balloons and Joy and may not taken or sold. Typically we do not take down any of our installs, unless a prop is rented from us which we will then to go back next day after the event to venue or party site to collect. Client agrees to pay . Balloons and Joy for any missing props such as Backdrop stand and bases.

4. Client will be responsible to take down after the event. But if you would like for us to take down we do offer this for a tear-down fee. 

5. We ensures proper installation /delivery of the décor and once set up is done and all décor are in place , Balloons and Joy will not be responsible for balloons that pop after set up . We will not be responsible for cleaning up and taking down balloons that float to the ceiling (some exceptions may

apply). 

6. Balloon decorations are purely for decorative purposes only and Balloons and Joy will not be liable for any misuse of balloons. All balloons are weighted down. As a safety issue to prevent power outages, never

release foil balloons up in the air. Un-inflated or broken latex balloons can be a choking hazard to young children and pets.. Keep these away from them to avoid accidentals suffocations. Adult supervision is required. 

7. Balloons and Joy cannot assume responsibility on the integrity of decorations placed outdoors during poor weather conditions (rain, strong winds, snow etc) 

8. CLIENT will be billed for any parking fees in the Venue.

It is the client's responsibility to provide accurate event details, including venue address, date, and time. Any changes or additional requirements should be communicated at least 2 days before the event.

License:

BALLOONS AND JOY and/or its licensors own the absolute rights to all intellectual property used as material on balloonsandjoy.com. We reserve all these rights for the use and distribution of our articles and/or products.

You must not:

• Copy material from balloonsandjoy.com.

• Sublicense material from balloonsandjoy.com.

• Sell or rent material from balloonsandjoy.com.

• Reproduce or duplicate material from balloonsandjoy.com.

BALLOONS AND JOY reserves the right to monitor all comments and remove any that may be deemed inappropriate, offensive, or otherwise in violation of these Terms and Conditions.

We are not in the business or committed to filtering, editing or reviewing comments on the Website. Comments cannot be linked to a point of view belonging to BALLOONS AND JOY. The comments are their own and reflect the point of view of the person who publishes it. We disclaim any liability involving damage caused by third-party comments posted on our website.

Hyperlinks to our content:

The following organizations may link to our website without prior written approval:

• Search engines.

• News organizations;

• Online directory distributors may link to our website in the same way that they hyperlink to the websites of other listed companies; and

These organizations may link to our home page as long as the link does not contain false or misleading information, does not imply false sponsorship, and fits the context of the linking website.

We will approve link requests from these organizations only if the link is in the best interest of ourselves and our accredited businesses, the organization has no negative track record involving us, and the link fits within the reporting context of general resources.

Approved organizations may hyperlink to our website by using our corporate name, by using the uniform resource locator you are linking to, and by using any other description of our linked website that makes sense in context and format of content on the linking party's site.

No use of the BALLOONS AND JOY logo or other graphic material belonging to us is permitted without a prior license agreement.

Responsibility for the content:

We are not responsible for content that appears on our website and may be construed as defamatory, obscene, criminal, or infringing and violating the rights of third parties.

Reservation of rights:

We reserve the right to request the removal of links that link us to your website. You agree to carry out our removal and revocation requests immediately. We also reserve the right to modify these terms and conditions at any time. By remaining linked to our website you agree to follow these linking terms and conditions.

Display & Promotion

By signing the Terms & Conditions, the Client agrees that Balloons and Joy may use the decorated display including video recordings and photographs for usage on the official Balloons and Joy website, including but not limited to social media networks, flyers, billboards, displays, commercials, and any other form of promotional marketing.

All designs/displays installed by Balloons and Joy are the property of Balloons and Joy, in return Balloons and Joy reserves the right to utilize any/all photographs and video recordings as deemed necessary, for promotional use. This also includes any personal photographs or video recordings taken by the Client or the Clients’ guests. IC reserves the right to 

include the official Balloons and Joy logo on any personal photographs or video recordings made, from an Balloons and Joy installation. Balloons and Joy also reserves the right to refuse to use any photographs or video recordings made by any of the following, including but not limited to; BB, the Client, the Clients’ guests, photographers, videographers, venue personnel, or any other vendors.

 

Removal of links from our website:

If you detect links on our website that encourage violence or defamation, it is your duty to contact us so that we can consider requests to remove links, even so we are not obligated to ensure that this information is correct.

Balloon Float Time

Your balloon decor will be designed around the specifications of your event.

• Latex balloons have an approximate float time of 12 hours.

• Mylar/Foil balloons have an approximate float time of 1 week.

• There are many variables that can affect the float time of your balloon decor including but not limited to weather, rain, wind, extreme heat.

• Please be aware of this if you are reserving a date for an outdoor installation.

Balloon Releases

Although balloon releases are intended to remember someone lost, support a cause, show respect for someone or something, and much more, Balloons and Joy does not participate in balloon releases of any kind, regardless the number of balloons requested. Balloons and Joy will not fill orders for anyone intending on releasing the balloons. Releasing balloons is detrimental to our environment in many ways. Balloons float hundreds, if not thousands of miles and when they land, they run a chance of landing in the ocean, in areas where livestock could accidentally eat them, or anywhere else as litter. We do not support, do not fill orders for and advise against participating in any balloon releases.

Outdoor Events

By signing the Terms & Conditions, the Client acknowledges that some balloon decor may be affected by temperature and humidity, something that Balloons and Joy can not be held liable for. Balloons and Joy will not be held liable for the reaction of any balloon decor to the weather or uncontrollable acts of nature including but not limited to rain, wind, or extreme heat. Balloons and Joy NEVER guarantees perfect results for any installation done outdoors or in these uncontrollable situations.

• In the event there is a situation that we prevents from installing the balloon decor in the original location at a venue, we is able to move the balloon decor to that location (still on site at original address) and attempt to complete the installation.

• Balloons and Joy is not responsible for poor services rendered by other vendors. It will be the Client’s responsibility to settle any discrepancies with the vendors directly.

• Balloons and Joy will not refund any payments made due to other vendors hindering or becoming detrimental to the progress and quality of the installation.

• Balloons and Joy expects any Client working with an Event Coordinator to ensure their coordinator is abreast of the installation arrangements prior to the day of the event.
